Precision Stock Picks (“us”, “we”, or “our”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), we have adopted the following policy regarding copyright infringement on precisionstockpicks.com (the “Site”).

We comply with the Notice and Takedown requirements of 17 U.S.C. § 512 of the Digital Millennium Copyright Act (“DMCA”). This site qualifies as a “Service Provider” under the DMCA. Accordingly, it is entitled to certain protections from claims of copyright infringement, commonly referred to as the “safe harbor” provisions. We therefore affirm the following Notice and Takedown Policy relating to claims of copyright infringement by our users.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied and is accessible on the Site in a way that constitutes copyright infringement, you may notify us by providing the following information in writing:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification

If you believe that your material that was removed or disabled is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to law, to post and use the content, you may send a counter-notification containing the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

Take Down Procedure

We reserve the right at any time to remove any material or activity on our site and material claimed to be infringing or based on facts or circumstances from which infringing activity is apparent. It is our policy to terminate the account of repeat copyright infringers, when appropriate, and we will act expeditiously to remove access to all material that infringes on another’s copyright, according to the procedure set forth in 17 U.S.C. §512 of the Digital Millennium Copyright Act (“DMCA”).

We reserve the right to modify, alter or add to this policy, and all users should regularly check back to these terms and conditions to stay current with any such changes.

Repeat Infringer Policy

It is precisionstockpicks.com’s policy to notify any user found to have uploaded copyright-infringing materials to the platform, and to terminate the upload privileges and/or account of those users identified as Repeat Infringers.

First-time infringers will be notified by email of any valid claims on their uploads. Beyond a first offense, infringing users may, at our sole discretion, have their uploading abilities temporarily suspended until they confirm receipt of our written notification of their infringement. Users identified at precisionstockpicks.com’s sole discretion as Repeat Infringers will be prohibited from uploading new material to the precisionstockpicks.com platform and may have their account disabled.
